Donova service terms.

These terms outline the commercial, acceptable-use, cancellation and service conditions for Donova AI receptionist services supplied by DEVECTUS.
11. Service scopeDonova answers calls, captures information, follows configured workflows, sends summaries and supports integrations agreed during onboarding. Customer-specific configuration, integrations, custom development, number handling and partner models may be scoped separately.
22. Customer responsibilitiesCustomers are responsible for approved scripts, business information, escalation rules, lawful call recording notices, caller consents, account access, payment details and reviewing AI-generated responses, transcripts and summaries before relying on them for sensitive decisions.
33. Trial, billing and renewalsTrial length, billing start date and renewal terms are as shown at signup or in the accepted order, proposal or agreement. Monthly and annual fees are charged according to the selected plan. Custom setup, integration, usage, recovery or partner terms must be confirmed in writing before work begins.
44. Acceptable useDonova must not be used for unlawful, abusive, deceptive, emergency-only, high-risk professional advice or regulated decision-making use cases without appropriate controls and written approval. Customers are responsible for the content and consequences of their configured call workflows.
55. Availability and supportDEVECTUS aims to provide a reliable service but does not guarantee uninterrupted operation. Planned maintenance, upstream telecommunications issues, third-party outages, payment failures, customer configuration issues and integration provider changes may affect availability.
66. AI limitationsAI voice responses, transcripts, summaries, classifications and sentiment outputs may be incomplete or inaccurate. Donova supports business workflows and is not a substitute for professional judgement, legal advice, medical advice, financial advice or other regulated professional advice.

Cancellation, suspension and account access.

Customers may cancel according to their plan or written agreement. Unless otherwise agreed, cancellation stops future renewals and access may continue only until the end of the current paid billing period. Fees already incurred for the current billing period, custom work, setup, onboarding, recovery work or integrations are generally non-refundable unless required by law or agreed in writing. After cancellation, suspension, non-payment or termination, DEVECTUS may disable or remove access to the Donova dashboard, phone numbers, call flows, voice configuration, integrations, recordings, transcripts, summaries and other account data. Customers should export or save any required information before cancellation or before the end of the billing period.

Important access notice

Once an account is cancelled, suspended or terminated, access may be lost permanently. DEVECTUS does not guarantee that cancelled accounts, deleted data, phone numbers, workflows, integrations or historical records can be recovered. If recovery or reactivation is available, it may require chargeable administration, technical work, reconfiguration, onboarding, number procurement, number porting or third-party provider fees.
77. Privacy and dataPersonal information, call recordings, transcripts, summaries, billing records and usage information are handled under the Donova Privacy Policy and any agreed customer configuration or data-processing arrangement. Retention periods may differ by data type, legal requirement, contract or operational need.
88. Customer data exportsCustomers are responsible for downloading, exporting or otherwise preserving business records they need before cancellation or termination. DEVECTUS is not responsible for a customer failing to preserve information before account access ends, except to the extent liability cannot be excluded by law.
99. Liability limitsTo the maximum extent permitted by law, DEVECTUS excludes liability for indirect, consequential, special or economic loss, including lost revenue, lost opportunity, lost data, lost access, interruption, reputational harm or claims arising from AI output accuracy, customer configuration, third-party systems or post-cancellation account loss.
1010. Liability cap and indemnityWhere liability cannot be excluded, DEVECTUS’ aggregate liability is limited to the fees paid by the customer for Donova in the preceding 12 months, unless a different cap is agreed in writing or a non-excludable law applies. Customers indemnify DEVECTUS against third-party claims arising from their use of the service, caller notices, configured workflows or breach of these terms.
1111. Changes to termsDEVECTUS may update these terms to reflect changes in law, suppliers, pricing, security, product behaviour or operating practices. Updated terms apply from the time they are published or otherwise notified, subject to any written agreement that says otherwise.
1212. Governing lawThese terms are governed by the laws of Victoria, Australia. Nothing in these terms excludes rights, guarantees or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
